Terms of Service

The terms of this agreement will be governed by the laws of the State of Ohio.  The state and federal courts located in Franklin County, Ohio will have exclusive jurisdiction over any case or controversy arising from or relating to this agreement, our website, or any services provided by NCASE MARKETING (NCASE, LLC). Each person who registers on this website consents irrevocably to personal jurisdiction in such courts with the respect to any matters and waives any defense of forum non conveniens. Furthermore, each person who registers on this website is deemed to have knowingly and voluntarily waived any right to a trial by jury in any case or controversy related to this agreement, our website or any services provided by NCASE MARKETING.  

Client Confidentiality and NDAs  

A client’s confidential information is typically needed when conducting a business relationship with NCASE MARKETING (NCASE). The preservation of a client’s privileged information is taken very seriously. All information concerning past, current, or future clients’ financial data, business records, or otherwise sensitive information is considered confidential by NCASE. NCASE may talk about past clients' actions or results from their activities, for demonstrative purposes only. However, NCASE will never disclose clients’ names or talk about them in ways that will make their identity known.  

No information will be released by NCASE without written authorization from a client.  

NCASE will be happy to cooperate with and adhere to any reasonable Non-Disclosure Agreement (NDA) as requested by a client. 

Cancellation Policy - Online Consulting  

All client bookings (sales) with NCASE are final. NCASE understands that time conflicts arise and changes to the plan are necessary. In these situations, clients are preferred to make any adjustments to their scheduled appointment, no later than 24 hours prior to the original confirmed date and time. NCASE will reschedule you at a new date and or time dependent upon her next availability. Please be aware, it is not feasible for NCASE to make current guarantees of future appointment availability. All re-scheduled appointments will be available on a first come basis. Refunds will not be issued for client “no-shows” or last-minute cancellations.    

Client Participation & Timeliness  

Client participation is highly important for NCASE to deliver marketing services. In order to maintain delivery schedules, NCASE expects all client input and replies to be done so in a timely manner. Any needed client information or documentation required for an NCASE service to be completed must be submitted to NCASE no later than two hours prior to a scheduled appointment. A client’s failure to submit required documents, proposals, or other “needed” information may result in an appointment being rescheduled or in worse situations, canceled by NCASE. NCASE is not liable for missed “deadlines” due to a client’s failure to respond in a timely manner.    

Warranties or Guarantees  

What works for some clients doesn’t work for all. Because there are so many variables that can’t be controlled by NCASE, each client’s situation and resulting outcomes(s) will always vary. The viewpoints, opinions, and examples NCASE uses during a consultation in no way serve as a guarantee of results for a client. Furthermore, instructions, services and tasks performed by clients and/or third-party vendors cannot guarantee results by NCASE.    

Client Third-Party Vendors and Service Providers  

NCASE regularly uses third-party vendors to supplement and provide marketing services for clients. While NCASE may highly recommend a third-party service provider, NCASE makes no warranty or guarantees of a third-party provider’s services or results, as this would ultimately be out of NCASE’s control. NCASE does not receive any commissions or forms of payment from vendor or provider associations or as a result of a client doing business with a recommended third-party provider. No formal partnership(s) of any kind exist with these entities; therefore, no warranties or guarantees can be made by NCASE.    

Confidentiality  

It is common that confidential or otherwise sensitive business information is needed to perform marketing services. However, NCASE will not share sensitive information with a third-party provider unless required for service fulfillment. In this case, clients will determine what information is or isn’t shared. Decisions to share information with outside parties, other than NCASE, is the sole responsibility of the client. NCASE will always guide a client to make “smart” decisions when it comes to privacy and all things marketing. However, the warranty and guarantee of confidentiality and privacy between third-party providers and the client is outside of NCASE’s control. Intellectual Property  

NCASE does not create any materials or offer any online services to the client that involve "original works of authorship." All content, photos, designs, artwork, and look and feel of the NCASE website are the sole intellectual property of NCASE. ANY use without explicit written permission is strictly prohibited. Violators will of this section will be pursued and punished to the full extent of the law.
